Terms of Service

These Terms of Service (the “Terms”) govern your use of olympusflowers.com(the “Site”) operated by Olympus Flowers LLC (“we”, “us”, “our”) and any orders placed through it. By using the Site or placing an order you agree to these Terms. If you do not agree, please do not use the Site.

1. Eligibility

You must be at least 18 years old and legally able to enter into a binding contract to place an order. By placing an order you represent that you meet these requirements and that any payment information you provide is your own and authorized for use.

2. Orders & pricing

Prices are listed in U.S. dollars and may change at any time without notice. The total at checkout is the binding price for that order and includes the arrangement, any character add-on fee, and the calculated delivery fee for the delivery address you provided.

We reserve the right to refuse or cancel any order, including for reasons of inventory, fraud prevention, delivery feasibility, or because the requested arrangement cannot be produced to our quality standards. If we cancel an order before delivery, you will receive a full refund.

3. Payment

Card payments are processed securely by Stripe, Inc. Olympus Flowers does not store your full card number; only a tokenized reference is retained for the transaction.

Charge timing. By default, your card is charged in full at the moment you place the order — payment in full is required to reserve materials and a delivery slot. Refunds, when due, are reviewed on a case-by-case basis as described in our Refund Policy.

For high-value orders or scheduled deliveries more than 7 days in advance, we may instead authorize the card at checkout and capture the funds when we begin preparing or delivering the order. The applicable flow will be clearly indicated on the checkout and confirmation pages.

4. Substitutions

Floral availability changes seasonally and by region. To honor delivery dates we may substitute individual flowers, container colors, or accessory items with components of equal or greater value while preserving the overall style, color palette and feel of the arrangement shown on the Site. Photographs on the Site are illustrative and the finished arrangement may vary slightly.

5. Delivery

We deliver within the service areas listed on the Site. Delivery windows are estimates and may be affected by traffic, weather, gated communities, building access, or recipient availability. It is your responsibility to provide a complete and accurate address (including apartment, suite, gate code, or other access information) and a phone number where the recipient can be reached.

If the recipient is unavailable and a safe location to leave the arrangement cannot be identified, we may leave the arrangement with a front desk, neighbor, or in a covered area at the recipient’s address, or attempt redelivery. Additional redelivery attempts may incur an additional fee. Olympus Flowers is not responsible for arrangements left at the recipient’s address per the sender’s instructions.

6. Cancellations & changes

Order changes (delivery date, address, recipient, message) can be accommodated at no charge if requested at least 24 hours before the scheduled delivery. Same-day changes may not be possible once preparation has begun.

Cancellations made 24+ hours in advance receive a full refund. Cancellations within 24 hours of delivery may incur a fee equal to the non-recoverable cost of materials and labor (typically up to 50% of the order total).

7. Communications & SMS

By providing your phone number you authorize us to contact you about your order via SMS, voice, or messaging apps. If you opt in to delivery notifications, you may receive transactional text messages (e.g. “your order is on the way”). Standard message and data rates may apply. You can opt out of marketing messages at any time by replying STOP; transactional messages related to an active order may continue until the order is fulfilled.

8. Intellectual property

All content on the Site, including images, designs, names, and logos, is the property of Olympus Flowers LLC or its licensors and is protected by U.S. and international copyright, trademark, and other intellectual-property laws. You may not reproduce, distribute, or create derivative works without our prior written permission.

9. Limitation of liability

To the fullest extent permitted by law, our total liability arising out of or in connection with any order is limited to the amount paid for that order. We are not liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, loss of goodwill, or emotional distress. Some jurisdictions do not allow these limitations; in such cases the limitations apply to the maximum extent permitted.

10. Indemnification

You agree to indemnify and hold Olympus Flowers LLC, its officers, employees, and agents harmless from any claims, damages, or expenses arising from your breach of these Terms or your misuse of the Site.

11. Privacy

Your use of the Site is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.

12. Governing law & disputes

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules. Any dispute arising under these Terms will be resolved in the state or federal courts located in Miami-Dade County, Florida, and you consent to personal jurisdiction and venue there.

13. Changes to these Terms

We may update these Terms from time to time. The “Last updated” date at the top of this page indicates when the latest version became effective. Material changes will be highlighted on the Site or communicated by email when appropriate.
